Terms of Service

These Terms of Service ("Terms") govern your use of the Fitly Chrome extension, the Fitly mobile app (iOS), our website, and related services (collectively, "Fitly" or the "Service"). By using Fitly, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Fitly provides AI-powered virtual try-on functionality across a Chrome extension and a mobile app, allowing you to visualize how clothing items may look on you. Fitly also offers related features such as body measurement estimates, look saving, sharing, and product discovery.

2. Eligibility

You must be at least 13 years of age to use Fitly. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Accounts and Authentication

Fitly uses secure third-party sign-in (such as Google Sign-In) to authenticate you. You are responsible for maintaining the security of your account and any activity that occurs under your Fitly session. Fitly does not store your sign-in provider password.

4. Photos and Consent

Fitly works by generating images that place clothing onto a photo of a person. Because these features involve a real person's likeness, you agree that:

  • You will only upload and use photos of yourself, or of another person who has given you their explicit permission to be used for virtual try-on.
  • You will not upload photos of any person without their consent, and you will not create, save, or share try-on images intended to impersonate, deceive, harass, defame, or otherwise harm any person.
  • You will not upload images that are sexually explicit, depict nudity, or that sexualize, exploit, or endanger a minor.
  • You are responsible for the photos you provide and for obtaining any permissions required for their use.

We take the safety of our community seriously. Fitly may use automated checks to help screen uploaded photos, and may remove content or suspend accounts that violate this section.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload content that is obscene, offensive, hateful, or violates the rights of others.
  • Attempt to reverse engineer, decompile, or tamper with the Service or its underlying systems.
  • Abuse, exploit, or circumvent usage limits or access controls.
  • Use automated tools, bots, or scripts to interact with the Service without prior written permission.
  • Impersonate another person or misrepresent your identity.

6. User Content

You retain ownership of the photos and images you upload to Fitly. By uploading content, you grant Fitly a limited, non-exclusive license to process that content solely for the purpose of providing the Service (for example, generating virtual try-on results and estimating measurements). Fitly does not claim ownership of your content and does not use your images for advertising or sale to third parties.

7. AI-Generated Results

Virtual try-on results are generated by AI models and are approximations only. They may not perfectly represent how a garment will look or fit in person, and they should not be relied upon as the sole basis for purchasing decisions. AI-generated images depict an approximation of your likeness and may not be used to misrepresent any person. Fitly does not guarantee the accuracy of try-on outputs or measurement estimates.

8. Free Access

Fitly is free to use, with weekly try-on and photo upload limits. These usage limits may change at any time. Please contact us at the email below with account questions.

9. Intellectual Property

The Fitly name, logo, website, extension, mobile app, and related materials are the property of Fitly and its creators. You may not copy, modify, distribute, or create derivative works based on any part of the Service without prior written permission.

10. Third-Party Services

Fitly integrates with third-party services including Google Cloud, Firebase, AI try-on and image-processing providers, and the platforms that distribute our apps (such as the Apple App Store and the Chrome Web Store). Your use of those services is subject to their respective terms and privacy policies. Fitly is not responsible for the availability, accuracy, or conduct of any third-party service.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Fitly does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, Fitly disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Fitly and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of the Service. In no event shall our total aggregate liability to you exceed one hundred U.S. dollars ($100).

13. Termination

Fitly reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, Fitly, or third parties. You may stop using Fitly and uninstall the extension or app at any time.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
